Terms of Service

Welcome to Swoodie. These Terms of Service (“Terms”) govern your use of the Swoodie mobile application and the website swoodie.app (the “Service”), operated by Swoodie (“we”, “our”, “us”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

4. Recipes and Content

Third-Party Recipe Data

Swoodie sources recipe data from third-party providers. We do not guarantee the accuracy, completeness, or reliability of recipe content, including nutritional information. You are responsible for verifying ingredients for allergens and dietary restrictions before cooking or consuming any recipe.

AI-Generated Content

AI-generated recipes, meal plans, and nutritional estimates (from Chef AI, recipe variations, AI nutrition estimation, Swoodie Scan photo analysis, and meal planning) are provided for informational purposes only and should not be considered professional nutritional or medical advice. AI-generated content may contain inaccuracies, including incorrect nutritional values, allergen information, or ingredient quantities. We are not responsible for any adverse effects, allergic reactions, health issues, or other consequences resulting from following AI-generated recipes, meal plans, or nutritional estimates. Always verify ingredients and nutritional data if you have specific dietary requirements or health conditions. Photo-based nutrition estimates produced by Swoodie Scan are AI-approximated and may differ from the actual nutritional content of your meal. Allergen detection is based on AI analysis and ingredient matching and is not guaranteed to be exhaustive. Always verify allergens and dietary suitability before consumption. Swoodie does not provide medical, dietary, or nutritional advice; consult a qualified professional for any health-related decisions.

User-Generated Content

When you submit content to Swoodie (such as ratings, comments, collaborative session input, or saved meal names), you retain ownership of that content. By submitting it, you grant Swoodie a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, and display that content solely for the purpose of operating and improving the Swoodie service.

5. Swipe Together

Swipe Together allows you to create sessions and invite others to collaboratively discover recipes. Creating a session requires a Swoodie Premium subscription. Joining a session with a code is available to all users. You are responsible for sharing session codes only with intended participants.

7. Intellectual Property

The Swoodie name, logo, design, and all associated intellectual property are owned by us. You may not copy, modify, or distribute any part of the Service without our prior written consent.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, Swoodie’s total liability for any claim arising from or related to these Terms or use of the Service shall not exceed the greater of (a) the amount you have paid to Swoodie in the twelve (12) months preceding the claim, or (b) 100 EUR.

Swoodie shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of data, loss of profits, or harm resulting from reliance on AI-generated content.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under Polish law.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms.

11. Governing Law

These Terms are governed by the laws of Poland. Any disputes arising from these Terms shall be resolved in the courts of Poland.

11b. Dispute Resolution

Before initiating formal proceedings, you agree to first contact us at support@swoodie.app to attempt to resolve any dispute informally. We will endeavor to respond within 14 business days.

If the dispute cannot be resolved informally within 30 days:

EU/EEA Users: You may submit a complaint to the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/ or to your local consumer protection authority.

All Users: Disputes shall be resolved in the competent courts of Poland, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

Class Action Waiver: To the maximum extent permitted by applicable law, disputes shall be resolved on an individual basis. You waive any right to participate in class or collective actions.

12. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Beta Features

We may from time to time release features marked as “Beta” or “Experimental.” These features are provided as-is, without warranty, and may change, behave unexpectedly, or be removed without notice. Use of Beta features is at your own risk.

15. Reporting Security Issues

If you discover a security vulnerability in Swoodie, please report it to security@swoodie.app rather than disclosing it publicly. We commit to acknowledging your report within 7 days and will keep you informed of our progress in resolving the issue.

13b. Accessibility

Swoodie is committed to making our app and website accessible to all users. We aim to conform to WCAG 2.1 Level AA standards.
